These general terms and conditions of sale concern the provision of interactive training and/or support for digital transformation, "Essential training for tourism professionals!", "AI & Tourism Course", "Your digitalization support course", "Master the Art of Revenue Management Course" (hereinafter referred to as the "GTC").

Article 1 - Purpose of the GTC
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in connection with a support service (hereinafter the "Services") offered by elloha, aimed at promoting the development of digital skills among companies in the tourism and leisure sector.

Article 2 - Obligations of the parties
2.1 The Support Partner
elloha provides support to the Beneficiary, in order to encourage it to adopt or reinforce the use of digital technology to improve its performance and visibility. For the duration of the Service, elloha will use its own resources and equipment to carry it out.
The Coach undertakes :

- not to promote a single commercial solution, but to objectively present several options adapted to the beneficiary's needs;

- to use, if necessary, videoconferencing tools while respecting the confidentiality of exchanges;

- not to record or reuse the contents of the sessions without the prior agreement of the beneficiary;

- to perform the Service in a professional and diligent manner.

2.2 The Beneficiary
Once their registration has been validated by elloha, the beneficiary undertakes to follow the training program and to actively collaborate in the smooth running of the Services. They will use their own IT resources to access the content and support. The beneficiary undertakes to respond to:
‍

- at the end of the Services, a satisfaction assessment (rating and recommendation);

- six (6) months after completion, to a follow-up enabling elloha to measure the impact of the support.

Article 3 - Prices
The price of coaching services ranges from €300 to €1,500 including tax, depending on the topic and duration. Details of the rates applicable to each training course are available on the websiteelloha or on the corresponding registration page.

Payment shall be made directly toelloha in accordance with the terms and conditions communicated at the time of registration. Any public aid or external financing that may be mobilized will be the subject of a separate agreement, independent of these GTC.

An invoice is issued and sent to the beneficiary at the end of the support, attesting to the effective completion of the service.

Article 4 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the beneficiary has a period of fourteen (14) days from the date of confirmation of their order to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided for by law.The right of withdrawal may be exercised by means of any unambiguous statement expressing the beneficiary's wish to withdraw, or by using the withdrawal form attached to these GTC.

Article 5 – Waiver of the right of withdrawal for e-learning courses

Thetraining coursesoffered by elloha of digital content without physical media or services that begin immediately after the order is placed, by granting access to the training platform. In accordance with Article L221-28 of the French Consumer Code, the beneficiary loses their right of withdrawal in the following cases:

5.1 Provision of digital content without physical media The right of withdrawal no longer applies when:

- performance begins before the end of the withdrawal period,

- the beneficiary has given their express prior consent to receive immediate access to training,

- and he acknowledged that he will lose his right of withdrawal as a result of this access.

Once access to the training has been granted, and subject to the express agreement of the beneficiary, no refunds may be requested.

5.2 Services fully performed before the end of the deadline

The right of withdrawal may no longer be exercised if the services have been fully performed before the expiry of the fourteen (14) day period and if their performance began with the prior express agreement of the beneficiary and with their acknowledgment of the loss of the right of withdrawal.

Article 6 – Express agreement of the beneficiary

Whenconfirming the order, the recipient is asked to check the following box (not pre-checked): "I accept elloha terms of use. elloha order cannot be finalized without this confirmation.

Article 7 – No right of withdrawal after accessing the content

Onceaccess to the training platform has been activated with the beneficiary's prior consent, the beneficiary may no longer exercise their right of withdrawal and no refund will be made, except in the following cases:

- technical malfunction completely preventing access to the training course,

- or situations provided for by mandatory legal provisions.

Article 8 - Duration

These GCS come into force upon acceptance by the Beneficiary. The Service must be provided within a maximum of three (3) months of registration.

Article 9 - Protection of personal data

As data controller, elloha and processes the personal data necessary for the management of the Services. This data includes, in particular:

- the beneficiary's surname, first name, contact details and job title;
- administrative information relating to the company (company name, SIRET, etc.).

Data is protected and stored in compliance with the RGPD and the French Data Protection Act. The beneficiary has the rights of access, rectification, deletion, limitation and opposition, which can be exercised at the following address:

The data is kept for the period necessary for administrative follow-up and proof of completion of the Services, in accordance with legal obligations.

Article 6 - Confidentiality

Information exchanged between the parties within the framework of the Service is strictly confidential. Each of the parties undertakes not to disclose it to third parties, except with prior written agreement.

Article 7 - Disputes and jurisdiction
These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing agreement within fifteen (15) days, the dispute will be referred to the Perpignan Commercial Court.
